Resource Adequacy Report: Evaluating the Reliability and Security of the United States Electric Grid August 06, 2025 The Attorneys General of Maryland, Washington, Illinois, Michigan, Minnesota, Arizona, Colorado, Connecticut, and New York move to intervene in this proceeding pursuant to Section 313l of the Federal Power Act, 16 U.S.C. § 825l, and request that the Department of Energy grant rehearing of its July 7, 2025 report titled "Resource Adequacy Report: Evaluating the Reliability and Security of the United States Electric Grid." The report claims the U.S. will face a significantly increased risk of power outages by 2030 if scheduled coal and natural gas plant retirements are allowed to proceed. It recommends keeping these plants running to maintain grid reliability. The coalition warns that the DOE report could be used as the basis to renew emergency orders under the Federal Power Act that force the continued operation of aging coal-powered plants. Multistate Coalition Letter Condemns U.S. Department of Education’s Burdensome Data Collection Proposal Is Thinly-Veiled Pretense to Attack Lawful DEI Efforts October 14, 2025 California Attorney General Rob Bonta today led a coalition of 18 attorneys general in opposing the Trump Administration’s proposal to require colleges and universities to submit data linking race to admissions, financial aid, and student performance. The U.S. Department of Education (ED) claims to be seeking data to assist it in enforcing Title VI, which prohibits discrimination based on race. Higher education institutions in California have not used race as a factor in admissions or financial aid since Proposition 209 passed in 1996. In the comment letter, Attorney General Bonta and the coalition argue that the proposed data collection would require these institutions to undertake new, costly, and burdensome data collection efforts on an unreasonable timeframe and is unlikely to yield high quality data or achieve ED’s stated goals. The coalition expresses concern that, instead of addressing purported racial discrimination in postsecondary admissions or ensuring compliance with Title VI, this data may instead be misused to improperly target colleges and universities with lawful diversity, equity, and inclusion initiatives or who have ideological differences with the current administration. Multistate coalition petitions the FDA to remove burdensome restrictions on mifepristone August 20, 2025 WA AG Nick Brown and 16 other states, as well as the District of Columbia, are requesting the U.S. Food and Drug Administration (FDA) remove burdensome restrictions on mifepristone, one of two drugs used in medication abortions, the most common means of abortion in the U.S.The coalition submitted a filing presenting extensive evidence on the safety of medication abortion in their states as well as the burdens imposed by the FDA’s continued restrictions on mifepristone. In the filing, the states join and supplement a citizen petition filed with the FDA by Massachusetts, California, New Jersey, and New York on June 5. The coalition urges the agency to eliminate unnecessary restrictions on this safe medication that make it much harder for patients to access medication abortions, particularly in rural and medically underserved areas. Multistate Coalition Files Comments Opposing EPA Rollback of 2024 Mercury and Air Toxics Standards Rule August 11, 2025 A coalition of 17 state attorneys general, the city of Chicago, New York City and the California Air Resources Board filed comments opposing the U.S. Environmental Protection Agency’s (EPA) proposal to repeal the 2024 Mercury and Air Toxics Standards (MATS) Rule and revert to outdated standards that would harm the environment and public health. The MATS Rule implements nationwide standards that limit emissions of toxic air pollutants from coal- and oil-fired power plants, such as mercury and other toxic metals, acid gases such as hydrogen chloride, and formaldehyde. Given significant developments in the technologies used to control pollution, in 2024 the EPA updated standards for emissions of these hazardous air pollutants from power plants. Multistate Coalition Calls on U.S. EPA to Withdraw Harmful Proposed Repeal of Greenhouse Gas Emission Standards for Fossil Fuel-Fired Power Plants August 07, 2025 A coalition of 23 states and cities has submitted a comment letter opposing the U.S. Environmental Protection Agency’s (EPA) proposal to repeal all greenhouse gas (GHG) emission standards for fossil fuel-fired power plants and to eliminate the basis for those standards — the determination that power plant GHG emissions cause harmful climate change. The coalition asserts in its comments that these standards protect against increased emissions and further acceleration of climate change. The proposal, if finalized, could increase carbon dioxide pollution contributing to climate change by eliminating existing requirements for power plants to take steps to control their carbon dioxide emissions.
